Wayne County Probate has continued to reform our language in the Letter of Guardianship for adult guardianships and our order appointing fiduciary.
The language in the Letter of guardianship provides that the “Guardian has authority to obtain financial information to determine the ward’s Social Security information and ability to apply for public benefits. Guardian has authority to apply to become representative payee for the ward’s Social Security benefits.”
We have created a local court form, the Guardian’s Financial Disclosure of Ward’s Assets (WCPC262 — http://www.wcpc.us/forms/wcpc262.pdf) and require that it be filed within 56 days from qualification of all adult guardians (and successor guardians). We updated our order appointing the fiduciary to indicate:
“Guardian shall file and serve on all interested parties, including the ward, the Guardian’s Financial Disclosure of Ward’s Assets, form WCPC 262, within 56 days of qualification as guardian (MCR 5.409(B)). If the ward’s assets exceed $10,000 total gross value, the guardian must file for protective order or conservatorship within 14 days of discovery of the assets.”
We also now indicate that when completing the annual report (AGW), if there is more cash or property than what was previously reported to the court, you must complete, file, and serve the Guardian’s Financial Disclosure of Ward’s Assets, form WCPC 262.
